Real Estate Matters

Real Estate Transactions

The Law Offices of Paula A. Miller, P.C., has almost 20 years of experience in all aspects of real estate law. We represent clients in residential and commercial transactions including negotiating contracts of sale, leases, and closings. We handle closings of residential homes, condominiums, cooperative apartments, vacant land, and commercial buildings. The firm will assist in securing the proper financing for your acquisition. For those clients who may benefit from a §1031 Tax Exchange, we are pleased to coordinate such a transaction. The firm will handle transactions within New York City, Long Island and upstate counties.

In these difficult financial times, the firm is also handling short sales, loan modifications, and foreclosure defense matters.

Paula A. Miller, previously an in-house lawyer at a title company, has vast experience with an array of title issues, including adverse possession, land disputes, ancient mortgage claims, fraudulent transfer claims, and chain of title issues. Our firm’s knowledge and experience in this area are critical to proper representation in any real estate acquisition or sale.

Staff at the firm is experienced and trained to provide “hands-on” and personal services to our clients. The goal is for all real estate transactions to proceed smoothly and efficiently, removing the worries and anxiety that typically come along with the purchase or sale of a property.

Real Estate Litigation

The firm has represented private individuals, businesses, lenders, and investors in a myriad of real property litigation matters. Real Property may be the largest asset owned by an individual or business and it must be protected. At times, disputes arise over property lines, contract terms, title issues, mortgage/loan matters, and ownership rights. Our firm has successfully litigated many real property-related disputes, taking the cases to a trial, if necessary.

Many real estate lawyers are familiar with contract negotiations and closings but have no knowledge or experience with the disputes that may arise over the course of a transaction. In this case, litigation may become necessary. Our firm has handled litigated cases involving real property contract disputes, forfeitures of down payments, adverse possession, specific performance, mortgage discharge, and foreclosures. Litigation involves motion practice, discovery, court conferences, depositions, trial preparation and presentation of the case at trial. Vital to any litigated case is preparation. Attorneys at the firm work tirelessly to prepare every case to the fullest so that the probability of success is great. Such preparation is evident in the successful outcomes of most of our cases.

Landlord/Tenant Matters

The firm represents Landlords in drafting residential and commercial leases as well as evictions in all District Courts on Long Island and the Civil Courts in New York City.

Commercial Litigation/Transactions

The Law Office of Paula A. Miller, P.C. handles commercial litigation matters including collections, business disputes, and estate litigation.  The firm has represented parties in the sale or acquisition of businesses including medical practices, retail establishments, service providers and restaurant/pub businesses. Attorneys at the firm have experience in securing liquor licenses through the New York State Liquor Authority, an application that may be daunting for those who have no experience in this area.

Personal Injury Litigation

If you or a family member have been injured due to the negligence of others, you may have grounds for a personal injury lawsuit. Such a case will compensate you for your loss or injury, including lost wages if you were required to miss time from work. The firm handles personal injury cases in the following areas:

  • Automobile and Motorcycle Accidents
  • Workplace Injuries
  • Slip and Fall Cases
  • Dog Bite Cases
  • Premises Liability Cases
  • Wrongful Death Cases

Even if you are partially to blame for the injuries you sustained, you may still be entitled to some compensation. Often times, another individual or entity may be reckless or negligent and have contributed to the cause of the accident. A successful personal injury lawsuit will result in the judgment that you deserve for your injury including lost wages, pain and suffering, and medical expenses.
